Terms of Service

These Terms of Service ("Terms") govern your use of the Nemis mobile application ("the App"), operated from Switzerland. By creating an account and using Nemis, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 16 years of age to use Nemis. By creating an account, you confirm that you are 16 or older. If we discover that a user is under 16, we will immediately terminate their account and delete all associated data.

2. Account Responsibility

You are responsible for maintaining the security of your account credentials. You must not share your account with others. You are solely responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at support@nemispro.com.

3. Acceptable Use

When using Nemis, you agree NOT to:

• Use the App for any illegal purpose
• Harass, bully, threaten, or intimidate other users
• Post offensive, discriminatory, or inappropriate content
• Attempt to manipulate gamification mechanics (fake check-ins, location spoofing, HealthKit tampering)
• Use automated tools, bots, or scripts to interact with the App
• Reverse-engineer, decompile, or attempt to extract the source code
• Impersonate another person or misrepresent your identity
• Upload malicious content or attempt to compromise App security

Violation of these rules may result in immediate account termination without notice.

4. User-Generated Content

Team chat messages, community feed posts, reactions, and other content you create ("User Content") remain your property. However, by posting User Content, you grant Nemis a non-exclusive, worldwide, royalty-free license to display and distribute that content within the App for the purpose of providing the service.

We reserve the right to remove any User Content that violates these Terms. Team chats are group conversations visible to all team members. There is no private messaging feature in Nemis.

5. Health and Fitness Disclaimer

Nemis is a motivational and gamification tool. It is NOT a substitute for professional medical advice, diagnosis, or treatment. We are not certified personal trainers, physiotherapists, or medical professionals.

• Always consult a healthcare professional before starting any exercise program
• You exercise at your own risk and are solely responsible for your physical wellbeing
• Nemis does not guarantee any specific health or fitness outcomes
• If you experience pain, dizziness, or discomfort, stop exercising immediately and seek medical attention

By using Nemis, you acknowledge that you participate in physical activities at your own risk and release Nemis from any liability related to injuries, health issues, or adverse effects.

6. Intellectual Property

The Nemis name, logo, design, gamification system, code, and all associated intellectual property are owned by Nemis. You may not copy, modify, distribute, or create derivative works based on any part of the App without our written permission.

7. Payments and Subscriptions

Certain features may require payment (e.g., Gaincoin packages). All payments are processed securely by Stripe. All purchases are final unless otherwise required by applicable law. Prices may change with reasonable notice.

8. AI Home Workout Verification & Anti-Cheat

Home Workout Verification is an optional anti-cheat system that uses a 30-second camera recording and AI vision analysis to confirm that a real workout is taking place before awarding a check-in.

• The 30-second video is recorded and processed on your device. Five frames are extracted locally and sent to our AI vision provider (OpenAI GPT-4o-mini) for movement analysis; the original video is then deleted and never uploaded
• You agree to use this feature honestly. Submitting pre-recorded footage, static images, videos of other people, or any content designed to trick the AI is a breach of these Terms
• The AI decision is final for the purposes of awarding in-app rewards. False positives and false negatives may occur; if verification fails, no streak, check-in or Gaincoin is granted
• Repeatedly attempting to defeat the verification system, or any other anti-cheat mechanism (GPS spoofing, HealthKit tampering, etc.), may result in forfeiture of streaks, Gaincoin and badges, and/or account suspension

9. Apple HealthKit Integration

If you grant Nemis access to Apple HealthKit, you authorise the app to read a limited set of workout and activity data (workout type, duration, active energy burned, step count) for the sole purpose of auto-awarding check-ins and gamification rewards in accordance with our Privacy Policy.

• HealthKit data is handled under Apple's HealthKit terms and will never be used for advertising, sold, or shared with third parties
• You can revoke HealthKit permission at any time via iOS Settings › Health › Data Access & Devices. Doing so disables auto-check-ins but does not affect the rest of the app
• Attempting to inject, falsify, or otherwise manipulate HealthKit data to gain rewards is a violation of these Terms

10. Screen Wake During Workouts

While a workout timer, rest timer, or Home Workout Verification recording is active, Nemis will request that iOS keep the device screen awake so your session is not interrupted by the auto-lock. This is scoped to active workout screens only and is released automatically when the workout or recording ends. Keeping the screen on may increase battery usage during long sessions.

11. Account Termination

You may delete your account at any time through the Settings page. Upon deletion, your personal data will be permanently removed within 30 days as described in our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or pose a risk to other users, without prior notice or refund.

12. Limitation of Liability

To the maximum extent permitted by law:

• Nemis is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid to us in the 12 months prior to the claim
• We are not responsible for service interruptions, data loss, or third-party service failures
• We are not liable for injuries sustained during exercise or physical activity

13. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Switzerland, unless mandatory consumer protection laws in your jurisdiction require otherwise.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App. Continued use of Nemis after changes constitutes acceptance of the updated Terms.
